Clifford Martin, a state prisoner, appeals from the dismissal of his petition for federal habeas corpus relief. In challenging his conviction and sentence, the petitioner contended that: (1) he was not advised of his Miranda rights when arrested, (2) he was denied a preliminary hearing prior to trial, (3) he was sentenced to a longer term of imprisonment than his codefendant, and (4) his court-appointed attorney failed to prosecute an appeal from his conviction. North Carolina conceded that Martin had exhausted his state remedies as to claims (1), (2) and (4). The district court found no merit in them. Although exhaustion had not occurred with respect to claim (3), the district court decided that it was lacking in merit.
